Election Petition tribunal sitting in Asaba has affirmed the victory of Senator Peter Nwaboshi, representing Delta North in the senate as duly elected in the last election into the Senate.
Also, the election of Senator James Manager, representing Delta South in the senate was quashed at the tribunal.
In the judgment presented by Justice C. O. Onyeabo, chairman of Panel 2 of the tribunal, it was affirmed that the Prosecution Witness 2 had been able to prove his case of over voting and other irregularities beyond every doubt.
In the judgment which lasted for more than three hours, Justice Onyeabo ordered that fresh election be held in six Local Government Areas of the senatorial district namely- Isoko North, Warri North, Burutu, Bomadi, Patani and Warri South-West.
Speaking to newsmen after the judgment, Counsel to Senator James Manager, Selekeowei Larry SAN expressed displeasure at the judgment, adding that they will appeal the judgment.
In another judgement, Deputy Senate President, Senator Ovie Omo-Agege was affirmed by the election tribunal.
In a judgment delivered by Justice A. M. Abubakar, chairman Panel 1, the tribunal upheld the election of Senator Ovie Omo-Agege of the All Progressives Congress (APC), while claiming that the complainant was unable to prove his claim of electoral irregularities during the election.
Senator Omo-Agege, who is representing Delta North in the Senate defeated Mr Evenly Oboro at the last general elections.
Speaking to Journalists after the judgment, counsel to Senator Omo-Agege, Barr. Omonade Matthew commended the tribunal for a thorough job. He noted that the judgment has rekindled the hope of the people in the judiciary, adding that the complainant could not present any evidence of irregularities during the election.
